Terms governing customer testimonials and creative materials for promotional purposes

Testimonials

Thank you for your willingness to submit a testimonial detailing the experience you’ve had with GelatoConnect or GelatoCreate. We are very happy to listen to your voice and experience. Please, read below the detailed terms for our testimonials.

By submitting this form or providing your testimonial over email, you grant Gelato the authorization to use your testimonial, or a part thereof, (irrespective of the format it may be provided in: video, written review, etc.) together with your personal name, business/ company name, and logo, in Gelato's marketing and public relations efforts, and to publish it on public platforms such as our website gelato.com, social media pages, advertising material, and any other channels or media Gelato may deem appropriate.

You represent that you are the owner or an authorized representative of the company that you provide a testimonial on behalf of and that you have the power and authority to grant this testimonial.

By providing this testimonial and any associated content, you warrant and represent that the content of your testimonial, including any related material, and the sharing thereof by Gelato will not infringe a third party's intellectual property or other rights (including without limitation copyrights, trademarks, rights of publicity, and rights of privacy) or violate applicable law.

You acknowledge and understand that the testimonial is granted free of charge and that you will not claim any financial compensation.

You agree that any dispute relating to this testimonial will be governed by the laws stated in the agreement governing your relationship with Gelato, such as for Gelato Create the Gelato API Terms of Service or for GelatoConnect the Terms of Use for the relevant module, applicable between Gelato and you.

Specific terms applying to video, audio and photography content

In certain situations, Gelato will collaborate with you to create and/or or use some photographs or videos featuring some of your products or facilities for promotional purposes:

1. If you provide Gelato with some photographs, video or audio content that you own the copyright of, you agree, by submitting this form, to grant Gelato a perpetual  license to use such material as described below.

2. In the event that a Gelato team member has visited your offices, home, or staged shooting location and created videos, photographs and/or editorial content, you acknowledge, by submitting this form, that Gelato owns the copyright of such material. 

In both cases, Gelato shall be free to use all such material in its marketing and public relations efforts, and to publish it on public platforms such as our website gelato.com, social media pages, advertising material, and any other channels or media Gelato may deem appropriate. Gelato may also sub-license all such material as it may deem appropriate.

In the event that the videos or photographs feature individuals and/or personal data, Gelato shall collect consent from the concerned individuals before publishing. In application with applicable data privacy laws, any individual may revoke his/her consent, and/or exercise his other data subjects rights at any time by sending a notification to [email protected].
